Public hearing
for Bishop Development rezoning request was called to order by Chair Kubicek.
Present: Kubicek, Borucki, Blair,
Absent: none
Also present: Jim Foulds and Vern Fountain of CPS.
Erik Walter
of Knaggs, Harter, Brake & Schneider, representing the applicant
explained that this is a 10 -15 year plan with no specific plans at this time.
Their request aligns with the master plan and they will work with the
community about their concerns. There are no utilities on these parcels at this
time. He explained that they are doing
a similar request in
Brenda Finch
7232 Pats Drive asked where their projects are in

9453 Billwood asked about future plans for
Kubicek asked about access where?
No plans now will be developed in the future.
Johnson stated that the only access
is off Billwood.
Gary Brzak
9511 Billwood asked for clarification of the map he received and asked if they will
force out others to get the other parcels.
Concern over value of homes in area if all commercial
around them. Walter explained
that the area could be developed with things like brick and a mix of types
of buildings that will leave the areas looking nice and not deplete the values.
Kubicek explained that there is a two
step process and that site plan review would cover specifics if they were
to get their rezoning.
Gary Brzak
asked about all the land that
has been rezoned to commercial and is setting empty.
Blair explained about the water going to Kamphuis property,
which has held up that development.

9541 Billwood restated that there is no access off

7281 Pats Drive asked why just a single lot of commercial request on
Brenda Finch
agreed that they own two lots and the offers have not been good.
Kirk Curtis
6755 W Galway stated that the new development across the street will most likely not
like having commercial to look at. Also
concern over 50 acres of new homes and commercial traffic on Billwood. Where would they get water & sewer?
William Tressel
7157 Pats Drive asked if the property at
Darin Naramor
7227 Pats Drive said that development in there would cause mud pits
and would bull doze everything down and lower values.
Kirk Curtis
stated
that the woods are a buffer zone from Don's Truck Stop.
Teri Robison
9446 Billwood stated that they moved out here and were surprised how quiet it is with the truck stop
down the road. She also said that they do not have the big heavy trucks on
their portion of the road and she is now concerned if adding homes and commercial
zoning.
Public Hearing closed at
Chair Kubicek called the regular meeting to order.
Minutes of previous meeting were approved as printed.
Blair gave report from Board of Trustees and Sewer
Board.
Kubicek gave report from Board of Appeals.
BISHOP DEVELOPMENT
REZONING REQUEST:
Foulds reviewed his report and discussed B-2 zoning.
He stated it is hard when there are no plans.
Master plan shows part of it commercial.
He also said that site review would handle access/traffic impact/buffering/
etc. This is a use Vs comp plan.
Kubicek asked if you could require a traffic impact
without site plan?
Usually not.
Foulds restated that a rezoning is based on use not
site plan. Nothing can happen on the
land without a site plan.
Borucki stated that he is concerned that anything allowed
in B-1 and O- 1 would also be allowed. Homes
would be impacted by this more than anything else. He stated that the traffic is heavy on this
road in morning and
Walter stated that the owner does not know what he
wants to do but could use generic numbers for traffic. Foulds asked if he thought the applicant would
to this? Probably.
Johnson moved and Borucki seconded to table the Bishop
Development Rezoning request until more information can be received.
Carried unanimously.
Clerk discussed how the zoning acts are being combined.
MTA will offer classes in the summer.
Borucki reported on the MSU class he took.
With no further business Borucki moved and Pray seconded
to adjourn the meeting. Carried unanimously. Adjourned
