WINDSOR CHARTER TOWNSHIP PLANNING COMMISSION

REGULAR MEETING - OCTOBER 12, 2005

MEETING ROOM - 7:00 P.M.

 

Meeting was called to order by Chairperson Arnoldo Martinez.

Present: Martinez, Borucki, Blair, Marsh, Pray, Johnson, Kubicek

Also present: J Richard Robinson, PC; Jim Foulds & Vern Fountain of CPS

 

There were no public comments.

 

Minutes of previous meeting were approved.

 

Blair gave report from Township Board.

 

Kubicek gave report from Board of Appeals.

Martinez shared that Tri County Planning voted 9-4 against the applicant's request to reclassify Lansing Road.

 

Foulds reviewed his report and the uses in M-1 zoning.   He stated that the only use that Mr. Lange proposes that needs a Special Use Permit is the two types of racing. This makes 15 of the 17 listed items use by right.  His report reviews the standards for a Special Use Permit.  He reviewed the documents that have been submitted.

 

In summary the recommendation for this Special Use Permit is to recommend to the township board to deny the request based on the following:

 (1)     That the proposed site for the Michigan Horse Park does not meeting the traffic access standards as required by Section 8.6.3(4)(a) of the Windsor Charter Township Zoning Ordinance.  As stated in Section 8.6.3(4)(a) "All sites shall be located on a major or minor arterial.  All traffic ingress and egress shall be from said arterial."  The proposed site has access to Lansing Road, Pinch Highway and Nixon Road which are not classified as arterial roadways by the common classifications system utilized by the Eaton County Road Commission or the Michigan Department of Transportation.  Therefore, the site does not comply with the requirement of Section 8.6.3(4)(a) of the Windsor Charter Township Zoning Ordinance.

 (2)  The applicant has not adequately addressed defined sanitary sewer requirements and has not adequately addressed a source of the required transmission and treatment capacity.

  

 

Marsh moved and Johnson seconded to recommend to the Township Board to deny this Special Use Permit Request for the Michigan Horse Park based on our Planner's report in regards to the road classification and sewer requirements.

Ayes: Martinez, Kubicek, Blair, Johnson, Pray, Marsh

Nay: Borucki

 

Motion  passed 6-1

 

 

MCCABE PLAT SITE:

 

Foulds reported that the preliminary meeting was held and there were only a couple of minor changes as per his report.  All driveways will be on interior streets - none on Canal.   This proposed development is located on Canal south of Bridge Hwy.

 

Borucki moved and Blair seconded to recommend to the Township Board to grant tentative preliminary plat approval to McCabe's development on Canal road. Carried unanimously.

 

With no further business Marsh moved and Pray seconded to adjourn the meeting. Carried unanimously.  Adjourned at 7:27 PM.
