WINDSOR CHARTER TOWNSHIP PLANNING COMMISSION
REGULAR MEETING - DECEMBER 11, 2002
MEETING ROOM - 7:00 P.M.

Public Hearing for several zoning changes: B-2: height restriction to 40'; adding Bed & Breakfast to areas; adding Motor Vehicle repair to B-2 and Open Space Preservation was called to order by Chairperson Inge Kyler.
Present: Kyler, Martinez, Blair, Hall, Burnett, Kubicek
Absent: Slucter
Also present: Jim Foulds and Vern Fountain of CPS

Vern explained each change, as follows:

The 25' to 40' height is for the purpose of any higher commercial building. There were no comments.

The Bed & Breakfast was added to residential areas as a Special Use Permit and in non- residential areas by right. Asked if allowed in M-1 and M-2: NO. Hall commented that in one place it goes by facilities and not in other. Will drop the word facilities. No public comments.

Motor Vehicle uses will be added to B-2 [zoning district] as a Special Use Permit. Hall commented that the word minimum should be added before 15,000 square feet and that it should be #17 not 16. No public comments.

Jim Foulds explained the Open Space [Preservation] zoning which is in response to [State of Michigan] PA177. He explained the different parts of the ordinance and stated that the township attorney supports the options. Hall is concerned about the open space and who is in charge to maintain, pay taxes, etc. Also, the legalities of open space care and insurance.

Martinez moved and Hall seconded to adjourn the public hearing. Carried unanimously. Adjourned public hearing at 7:29 PM.

Minutes of previous meeting were read and approved as amended.

Blair gave report from Board of Trustees.

Kubicek gave report from Board of Appeals.

Hall gave report on Village of Dimondale Planning [Commission] Meeting and Recreation Committee. The Village would like to review master plans and recreation plans with the Township.

MIGALDI SITE PLAN:

Hall moved and Blair seconded to remove from the table the Migaldi site plan request. Carried unanimously.

The gentleman, Ivan, who did the traffic study was present, as well as, John Peckham and Sam Migaldi. Mr. Peckhan stated that the new sheets [of the site plan] are there for the south side and how they are leaving the trees and wetlands untouched.

The traffic study has been completed and page 27 tells the recommendations that the project needs. They have met with Blair Ballou, who was present at the meeting, and there are no problems with any of the recommendations. Some of the plans will be phased in as the project grows with projected [completion] date of 2008 for both east & west sides [of Creyts Road].

The Planning Commission asked several questions of verification about the traffic study. The report refers to Industrial but it was figured at Commercial use. Due to closure of Creyts Road they used some numbers from prior studies. If MDOT does not feel that Lansing Road/Davis needs a [traffic] light, at this point, [and] the developer does, the developer can pay for the light.

Blair Ballou, Eaton County Road Commission, generally agrees with the recommendations on page 27. If two extra drives are added they will need to have extra lanes there.

Blair asked if a light might be needed on Creyts Road? The spacing is good between driveways so Ballou does not think that will be needed. If the seconded [apartment/condo] project creates the need for a light, it is first come - first serve, as who does what.

Question was asked if the nine acres to the north are tied into the project at this time? No, they are not but will be at a later date.

Foulds had no additional comments and feels that the road commission and developers are talking and he is very confident that things will be done, as they are needed.

When asked about the billboards they stated that they will be gone and one of the new pages shows the proposed entrance and signs.

Martinez moved and Blair seconded to grant final site plan [approval] for the Migaldi property on Creyts Road as shown in the plans and contingent upon final approval from the Eaton County Road Commission. Also, that each small parcel will under go site plan review at the time they are developed. Carried unanimously.

Five-minute recess was taken.

ZONING CHANGES:

Hall moved and Kubicek seconded to send the zoning changes (max. 40' height in B-2; addition of Bed & Breakfast and Motor Vehicle repairs in B-2) to the Township Board for approval. Carried unanimously.

Hall moved and Martinez seconded to send the Open Space [Preservation] Ordinance to the Township Board for approval. Carried unanimously.

Clerk will meet with Jim Foulds to correct numbers of all new additions.

A draft of the site condo ordinance was distributed for review.

Hall stated he would like to see the maximum number of homes per acre in our chart.

With no further business Burnett moved and Kubicek second to adjourn the meeting. Carried unanimously. Adjourned at 9:17 PM.
