Public Hearing for David Haywood rezoning request was called to order by
Chairperson Inge Kyler with changes in the agenda.

Also present: Jim Foulds & Vern Fountain, Community Planning Services
The Haywood property is vacant land at the SW corner of Lansing Road & Creyts. They are requesting the change from R1B (residential) to B-2 (commercial) so it will conform with the property to the south, currently owned by the Migaldi's. This parcel is approximately 6.8453 acres. Kyler read the recommendation from the township consultants.
Fould had no comments.
Haywood stated they also own a small triangle north of this parcel but it is located in Delta Charter Township and they have requested B-2 rezoning for it. It has been sent to [Delta] township board with a recommendation to change. The B-2 in Delta is consistent with our B-2. They plan to develop similiar to Migaldi property with same access roads. The parcel will be serviced by water and sewer by Windsor Charter Township. This corner will never be used for residential. There is still one home in the area that will be added to the project at some time.
No questions from the planning commission members.
Joe Griffith, 7404 Creyts Road asked about the utilities and where they will come from. Water from the Board of Water & Light and sewer from Dimondale/Windsor Plant. No cost to the taxpayers or township. Pipes will be 20' deep except for the fire hydrants. They are doing a two stage bond project with all costs to developers. Mr. Griffith asked if he could be required to hook up? No capacity; so NO unless they bought it.
Discussion held on the fact that the sewer lines will be under Creyts Road and they will be inconvenienced while this takes place. Mr. Griffith stated that this road has held up and he hopes that it would be replaced to last, as well. Would have to meet ECRC [Eaton County Road Commission] standards.
When asked what is going in there? We do not know at this time.
Aaron Mix of Walnut Hwy asked what could do in a B-2 zoning? Kubicek read the list from the zoning ordinance.
Jane Linn, 10089 Lafayette asked if all this activity would increase the need for police [services]. Probably, at some time, as activity will increase.
Griffith asked when the sewer construction would be starting. Probably by September 1, 2002 and be done by the end of asphalt season. The northern end will become 3 lanes.
Kyler stated that construction is inconvenient but does not last forever.

Slucter moved and Burnett seconded to approve the minutes of July meeting. Carried unanimously.
Blair gave report from Township Board.
Kubicek gave report from Board of Appeals noting that we might need to look at [Zoning Ordinance] page 103 and buildings in the front yard.
Hall reported on Village Recreation meeting.
Kyler reported on stormwater meeting and Village Planning Commission.
Towsley reported on recycling meeting.
Hall reported on MTA workshop attended by several members of the Board on new planning laws.
HAYWOOD REZONING:
Slucter compared our B-2 with Delta's and they are very similar and the intents are the same. Delta Charter Township has recommended adoption of the change to their township board.
A very lengthy discussion was held on the fact that the Migaldi property has started to move dirt and they have not gone through site plan review. Many members feel that a traffic study needs to be done on Creyts Road. Discussion held on the traffic study. At this time there is no action on the [property on the] East Side [of Creyts Road].
Haywod commented that you can not forced 5 lanes to be built and he has a possible offer so he will not be involved in a traffic study.
Hall stated that this rezoning fits the Master Plan and is logical and is the next step. Martinez stated that we need to separate the two items (rezoning & site plan/traffic).
Hall moved and Blair seconded to recommend to the Township Board to rezone the Haywood property from R1B to B-2. Carried unanimously.
Discussion prior to vote: Slucter concerned we are loosing our leverage and we need to tread slowly. Would it hurt to wait 30 days? Yes, purchase order would expire. Haywood expressed concern over holding him up for a site plan review that centered on Migaldi property and this is not residential property. The actual development to take place is unknown at this time. Discussion over who would do a traffic study and how it would be done since unsure of tenants. The study is based on range of uses and we can require it, per Foulds.
8:24 P.M. Recess took place.

ENFORCEMENT COMMITTEE REPORT:
Martinez gave the report from the committee. They looked at range of salaries and gave basic information. Feel that Windsor should write specific job description. The job could be part or full time and employee would fall under the Supervisor control. Blair stated that the board would most likely want to know how the system would work. Blair will take the recommendation to the Township Board.
Martinez left the meeting at 8:45 PM for personal reasons.
CRYSTAL WOODS REZONING REQUEST:
Mark Mohrenweiser, representing this project, stated they are looking at changing the R1B to R1D on 38 acres. When they were last here, April 2001, they took notes and tried to address the concerns of the neighbors. With traffic being one, they have purchased land for access to Waverly Road and are still working with the church for an easement. They will connect up with Bridgeport and Little York Drive.
They are looking at single family homes with 70' frontage. At this time no multiples are being planned. They have open drain/wetlands they need to work around. There will be some open space. They have met with the drain commissioner.
Hall asked about open space. Will be a homeowners association to take care of it and it can be used by owners.
Slucter moved and Burnett seconded to set the public Hearing for the Crystal Woods rezoning for September 11, 2002 at 7:00 PM. Carried unanimously.
OPEN SPACE:
Foulds shared the new zoning laws and discussion took place.
MASTER PLAN:
Need to send copies to the people who received letters and Tri County.
With no further business Blair moved and Kubicek second to adjourn the meeting. Carried unanimously. Adjourned at 9:43 PM.
